These Terms & Conditions (“Terms”) govern use of https://www.backflowschool.com/ (the “Site”) and registration for training and related services provided by Water Industry Training Specialists, Inc. (“WITS,” “we,” “us,” or “our”). By registering for a course or affirmatively accepting these Terms, you agree to them. Browsing the Site does not, by itself, constitute agreement to every contractual provision in these Terms.
1. Who We Are and Eligibility
WITS is a California-based provider of workforce training in backflow prevention assembly testing, cross-connection control, automatic control valves, and related subjects. Unless a specific course expressly provides otherwise, students must be at least 18 years old and meet the published course prerequisites. A parent, employer, or other individual may browse the publicly accessible Site without enrolling.
2. Use of the Site
You agree to use the Site lawfully and not to attempt unauthorized access, disrupt its operation, introduce malicious software or spam, misuse personal information, or use automated tools in a manner that harms the Site. We may reasonably limit access to protect security and other users, subject to applicable law.
3. Accounts and Security
Certain registration or account-management features may require a user account. Provide complete, accurate registration and contact information; safeguard any login credentials; and promptly report suspected unauthorized account access to info@backflowschool.com. We may suspend access for security concerns or material violations, subject to applicable law. Our collection and handling of personal information are described in our Privacy Policy at https://www.backflowschool.com/privacy-policy/.
4. Course Registration, Delivery, and Scheduling
WITS primarily offers scheduled, instructor-led classroom instruction and supervised hands-on training. Course descriptions, dates, locations, required materials, prerequisites, fees, attendance rules, and assessment requirements are shown in the applicable course listing or registration materials. Students are responsible for reviewing those requirements before enrolling. A registration is subject to confirmation and any applicable payment requirements. WITS may reasonably change instructors, classroom assignments, or course materials. Where operationally necessary, WITS may reschedule or cancel a course and will communicate available options and any refund rights under the published Refund & Cancellation Policy and applicable law. WITS will not retroactively apply a material change to an existing paid enrollment without a lawful basis.
5. Payments, Pricing, Cancellations, and Transfers
The price and any additional fees disclosed during checkout apply to the purchase. Students or sponsoring organizations authorize charges to their selected payment method and represent that they are authorized to use it. Any payment deadlines, refunds, student cancellations, no-shows, substitutions, or transfers are governed by the Refund & Cancellation Policy presented at registration, together with applicable law and any written enrollment agreement. Read the Refund & Cancellation Policy at https://www.backflowschool.com/refund_returns/ before registering. Any nonrefundable or administrative fees must be clearly disclosed before payment. Billing errors will be corrected in accordance with applicable law.
6. Student Conduct and Academic Integrity
Students must treat instructors, staff, and classmates respectfully, follow reasonable classroom and safety instructions, avoid harassment and threatening or disruptive conduct, and complete assessments honestly. Impersonation, unauthorized assistance, falsified records, and misrepresentation of course completion are prohibited. WITS may take proportionate action, including a warning, removal from an activity, or removal from a class when reasonably necessary for safety or integrity. Any financial consequence or refund determination will follow published policies and applicable law.
7. Attendance, Assessments, Certificates, and CEUs
Course completion, certificates, contact hours, and continuing education units (CEUs), where offered, depend on meeting the specific course’s published attendance, participation, assessment, and other completion requirements. Missing required instructional time or failing an assessment may prevent issuance of a certificate or CEUs. WITS may verify attendance and assessment results and decline or correct documentation where the requirements were not met or records were falsified. WITS provides training and may issue documentation of successful course completion; WITS does not itself award professional backflow tester certification or other third-party licenses. Professional certification, licensing, examination eligibility, and renewal are determined by the applicable external certifying or regulatory body. Completing a WITS course does not guarantee certification or passing an outside examination.
8. Intellectual Property and Course Materials
The Site, WITS-created materials, branding, photographs, instructional presentations, handouts, and other protected content belong to WITS or their respective rights holders. Enrolled students may use lawfully supplied course materials for their own study and authorized professional reference, subject to any publisher restrictions. Do not reproduce, distribute, record, livestream, publicly post, resell, or commercially reuse protected content without permission or another lawful basis. Purchased third-party manuals remain subject to their publishers’ rights and any applicable license terms.
9. Educational Information; No Certification Guarantee
Courses are intended for educational and professional development purposes, not as individualized legal, engineering, or regulatory advice. Codes, certification rules, and field conditions can change and may vary by jurisdiction. Students and employers remain responsible for verifying current requirements applicable to their work. WITS does not guarantee licensure, certification, employment, promotion, examination passage, or a particular business result.
10. Website and Course Information Disclaimers
We strive to provide accurate, current, and accessible information, but occasional website errors or service interruptions may occur. To the extent permitted by law, online content is provided without a guarantee of uninterrupted availability. Nothing in these Terms disclaims warranties or obligations that cannot lawfully be excluded, or limits responsibilities WITS has expressly undertaken for its training services.
11. Limitation of Liability
To the extent permitted by applicable law, WITS is not responsible for indirect or consequential commercial losses caused solely by temporary Site interruptions or unauthorized misuse of the Site by third parties. Nothing in these Terms excludes or limits liability for personal injury, gross negligence, willful misconduct, statutory rights, or other liabilities that may not lawfully be limited.
12. Responsibility for Misuse
Students are responsible for their own intentional misconduct, unlawful actions, and unauthorized use or distribution of protected WITS materials. Nothing here requires a student to defend or indemnify WITS for WITS’s own negligence, misconduct, or other obligations for which an indemnity would be unenforceable.
13. Third-Party Services and External Links
The Site may link to external resources or use independent payment, website hosting, or registration service providers. Those providers may have separate terms and privacy notices. WITS does not control content published on independent third-party websites, but remains responsible for its own duties under applicable law. Links are provided for convenience and do not necessarily imply endorsement.
14. Governing Law and Disputes
California law governs these Terms, subject to mandatory consumer protections and other applicable laws. WITS’s principal business address is in Sunnyvale, California.
15. Updates to These Terms
WITS may revise these Terms prospectively and will update the effective date when revisions are published. We may provide additional notice of material changes. For a course already purchased, the registration terms and policies accepted at purchase will not be displaced by a later material change unless applicable law permits it or the student agrees to the change.
16. Wet Lab, Equipment Use, and Safety
Hands-on instruction and access to the WITS Wet Lab are permitted only during authorized activities and within the access periods provided for the applicable course. Students must follow instructor and staff instructions; use equipment only as directed; wear any required protective equipment; promptly report hazards, damage, or injuries; and refrain from operating equipment when doing so would be unsafe. Students must not enter restricted areas or conduct unsupervised work unless WITS has expressly authorized it. WITS may stop unsafe activity or restrict equipment access when reasonably necessary. These rules do not replace WITS’s duty to maintain reasonably safe facilities or equipment.
17. Accessibility and Reasonable Accommodations
WITS is committed to providing access consistent with applicable disability and civil rights laws. Students who need an accommodation should contact WITS as early as practical before a course at info@backflowschool.com so that requests can be considered through an individualized, interactive process. WITS will not require unnecessary disclosure of medical information and will handle accommodation information as confidentially as applicable law requires. Requests are evaluated in accordance with applicable law, including safety and essential course requirements. Refer to WITS’s applicable accessibility or accommodation policy for additional details.
